Key points
  • Creditable coverage is drug coverage at least as good as standard Medicare Part D. While you have it, no late penalty builds up.
  • Employers, unions and retiree plans must send you a letter every year saying whether their drug coverage is creditable. Keep every one.
  • When that coverage ends, you have 2 months to join Part D without a penalty, not the 8 months you get for Part B.

Creditable drug coverage is drug coverage at least as good as standard Medicare Part D. While you have it, no late enrollment penalty builds up if you wait. That penalty is a lasting extra charge for joining Part D late. Without it, the penalty clock is running whether anyone tells you or not.

How you find out: the annual creditable coverage notice

Employers, unions and retiree plans must tell you every year, in writing, whether their drug coverage is creditable. The notice usually comes in the fall, before Annual Enrollment. That is the fall window for changing Medicare plans.

It is a plain one page letter. It looks like something you would throw away.

Keep every one of these notices in one folder, for good. They are the proof that removes a penalty applied by mistake. Social Security's records are not always complete. Five minutes of filing can be worth thousands of dollars later.

What is generally creditable

  • VA prescription benefits
  • TRICARE, the military health program
  • Most employer and union group drug plans from a current job
  • Many retiree drug plans, though you should check rather than assume
  • Federal Employees Health Benefits plans
  • Some Indian Health Service coverage

What is not

  • Drug discount cards
  • Pharmacy loyalty and savings programs
  • Help programs run by drug makers
  • Marketplace coverage, the plans sold under the Affordable Care Act, once you qualify for Medicare
  • Some retiree and COBRA drug plans, which may not meet the standard. COBRA is the option to keep a job's health plan for a while after you leave.

Discount programs can save you real money at the counter. None of them stop the penalty from building. They are not insurance.

If your coverage becomes non creditable

This happens. An employer changes plans, and the new one does not meet the standard. The notice will say so. That opens a short window to join Part D without a penalty.

Read the notice when it comes instead of filing it unopened. The window is short.

When employer coverage ends

You get two months to join Part D without a penalty, not the eight months you get for Part B. That mix up causes more needless penalties than anything else in Medicare.

There is also a 63 day rule. A gap of fewer than 63 days in a row does not trigger a penalty. Treat that as a cushion, not a schedule. See how the penalty is figured.

If you cannot find your notices

Ask your old employer, plan administrator or insurance company for a letter. It should show your coverage dates and whether the coverage was creditable. Most will send one if you ask.

Pay stubs that show the plan's premium, the monthly cost of the coverage, taken out of your pay can also back up an appeal. So can W-2 forms and explanation of benefits statements, the summaries a plan mails after it pays a claim. See what to do about a penalty when you had VA or employer coverage.

Next, find this year's notice and put it in a folder with the others. If you are not sure your coverage counts, call our McAllen office or send us your ZIP code through the form on this page. We will read the notice with you.

Common follow-up questions

Where do I get proof of creditable coverage?

Your employer or plan sends a notice each fall. If you no longer have it, ask the plan administrator or insurance company for a letter showing your coverage dates.

Is VA coverage creditable?

Yes. VA drug benefits meet the standard, so no penalty builds up while you use them.

Is COBRA drug coverage creditable?

Sometimes. Read the notice for that specific plan. Even when the drug coverage is creditable, COBRA does not protect you from the Part B penalty.
